Apple loses ‘copy cat war’ Vs Samsung

Apple has lost its appeal against a UK ruling that Samsung has not copied its iPad design.
Apple had appealed against the decision in July by Judge Colin Birss QC, who had decided Samsung's tablets didn't infringe Apple's registered design for the iPad. Today, jury at High Court in London have supported July decision. A UK judge said that Samsung's devices were not as "cool" because they lacked Apple's "extreme simplicity". He thought that few people would confuse the Galaxy Tab computers with Apple's iPad.
The appeal court could contrast in appearance and design between the two companies’ products. UK court’s decision matched with the decision of US jury that although some of Samsung's smartphone designs infringed Apple's iPhone designs, those of the Galaxy Tab tablets did not do so for the iPad.
The UK jury have forced Apple to publicise difference in two things. Apple still needs to run ads saying Samsung had not infringed its rights. Apple has now lost a series of lawsuits against Samsung based on the design of their tablets. These include cases in the Netherlands, Australia and US - despite sometimes winning temporary sales bans.
Apple can still appeal to the UK Supreme Court, otherwise the ruling applies across the European Union.
